PRIVACY POLICYThis privacy policy (hereinafter the "Policy") governs relations in the field of protection of personal data of visitors to the website https://hopetobe.org (hereinafter the "Website"), which belongs to the CHARITABLE ORGANISATION "CHARITABLE FOUNDATION "NADII BUTY" (EDRPOU code 45956568, Ukraine, 08149, Kyiv region, Bucha district, Sofiivska Borshchahivka village, Olhy Kobylianskoi St., building 5V, apartment 150), registered in accordance with the current legislation of Ukraine (hereinafter the "Foundation").
1. GENERAL PROVISIONS.
1.1. In this Policy the terms are used with the following meanings: • personal data base - a named set of ordered personal data in electronic form and/or in the form of personal data card indexes; • consent of the personal data subject - a voluntary expression of will by a natural person (provided they are informed) to grant permission to process their personal data in accordance with the stated purpose of such processing, expressed in a form that allows a conclusion to be drawn that consent has been given; • processing of personal data - any action or set of actions, such as collection, registration, accumulation, storage, adaptation, alteration, renewal, use and dissemination (distribution, realisation, transfer), depersonalisation and destruction of personal data, including with the use of information (automated) systems; • personal data - information or a set of information about a natural person who is identified or can be specifically identified; • personal data subject - a natural person whose personal data is processed; • third party - any person, with the exception of the personal data subject, the owner or the manager of personal data; • cookies - small text files that are stored in the browser of a device (computer, mobile phone, etc.) after visiting the Website, and which the Website transmits to the browser.
All other terms in the Policy are used with the meaning defined by the current legislation of Ukraine, including international legal acts ratified in Ukraine.
1.2. This Policy has been developed to inform personal data subjects about the procedure for processing their personal data when visiting/using the Website, and also to ensure the protection of their personal data during such processing.
1.3. This Policy, as well as the Foundation's activities related to the collection, processing, storage and other lawful actions concerning personal data, is governed by: • the Constitution of Ukraine; • the Law of Ukraine "On Personal Data Protection" of 01.06.2010 No. 2287-VI; • other current legal acts of Ukraine governing personal data protection; international legal acts ratified in Ukraine.
The legal relations arising for the Foundation in connection with the processing of personal data of residents of foreign jurisdictions are also subject to the law (including international law) and the national and international legal acts governing the protection
of personal data of residents of such countries.
1.4. The owner of the personal data processed in connection with visiting/using the features of the Website is the Foundation. The Foundation has the right to entrust the processing of personal data, in whole or in part, to third parties on the basis of an agreement concluded in accordance with the requirements of the current legislation. 1.5. A natural person is a personal data subject under this Policy if they are a visitor to the Website, including if they use any of the features available on the Website, and in particular if they provide the Foundation with their email address and name. 1.6. The Foundation guarantees that it: • follows proper practice and regulatory requirements for personal data protection; • protects the rights of personal data subjects; • prevents the risk of a breach of the security of personal data processing.
1.7. The purpose of processing personal data obtained in the course of the operation of the Website is for the Foundation to carry out its statutory activities.
1.8. Publication of this Policy at the link specified in clause 4.1 of this Policy constitutes notification to personal data subjects of the Owner, of the composition and content of the personal data collected in connection with visiting/using the Website, of the rights of such subjects, of the purpose of collecting their personal data and of the third parties to whom such personal data may be transferred.
2. PROCESSING OF PERSONAL DATA.
2.1. The Foundation may collect and process the following information about you: • information you provide to the Foundation: this is information about you that you provide by: using the Website and the features of the Website, subscribing to receive updates by email, making charitable aid (a donation) using the features of the Website, communicating with the Foundation through the features available on the Website, and so on;
• information about you collected by the Website and other systems:
1) if you visit the Website, third parties may collect certain information about you and your visit, such as the type and version of your browser, as well as the pages on the Website that you visit, and your internet protocol (IP) address;
2) the Website may also download cookies to your device;
3) if you contact the Foundation's staff via the Website or other means of electronic communication. • information collected about you by third parties on the Website through your actions: this is information about you that you provide to third parties (for example, Facebook, Google, Twitter) using the social media sharing features available on the Website, when moving from one page to another, or by viewing materials that link to (open on) other platforms (websites).
2.2. How the Foundation processes your personal data depends on how you use and interact with the Website. Some information may be provided directly by you while using the Website or in another way; other information may be collected and processed by the Foundation itself using the automated technologies employed on the Website.
2.3. Legal grounds for data processing: when you visit the Website, the Foundation processes your
personal data if
1) the Foundation has obtained your consent to such processing,
2) your personal data is necessary for the Foundation to conclude and perform a transaction with you or to take steps preceding the conclusion of a transaction,
3) in cases where the Foundation has a legitimate interest in processing your personal data, and that legitimate interest does not override your data protection interests or your fundamental rights and freedoms, and also
4) in other cases defined by the current legislation.
In some cases the Foundation may have a legal obligation to process your personal data, or may process your personal data to establish, exercise or defend legal claims.
2.4. Automated processing mechanisms: the Foundation and third parties may use automated information processing technologies to process information in some sections of the Website. The Foundation uses cookies to store content and settings, which allows the Foundation to process the standard information your browser sends to certain websites you visit, for example your IP address, your browser type and language, as well as the site you came from, the pages you visit and the links you click on the Website.
Having such technical information helps the Foundation improve the Website.
2.5. The Foundation may use your personal data only for the purposes defined by this Policy and the current legislation, in particular (but not limited to),
1) to process your request (enquiry) to the Foundation made via the Website,
2) to enable you to provide charitable aid (a donation) using the features available on the Website,
3) to fulfil other statutory goals of the Foundation in the manner defined by the current legislation;
4) to send letters and messages to your email address concerning promotional materials, information on the launch of charitable projects, requests and invitations to provide feedback on charitable activities, visits to the web resource and so on.
2.6. The Foundation may accumulate personal data processed in the course of your visiting/using the Website, including by entering this data into a personal data base. Your personal data is stored in compliance with the requirements of the current legislation on personal data.
2.7. Your personal data is disseminated solely with your consent or in the cases defined by this Policy and the current legislation.
2.8. The Foundation may partially publish user data on its Website in the Reporting and Receipts section.
2.9. Your personal data is subject to deletion or destruction in the event of:
• expiry of the 2-year storage period or another period defined by the current legislation;
• termination of the legal relationship between the personal data subject and the Foundation, unless otherwise provided by legislation;
• in other cases defined by the current legislation on personal data protection.
2.10. The Foundation does not process personal data on racial or ethnic origin, political, religious or philosophical beliefs, membership of political parties and trade unions, criminal convictions, or data concerning health, sexual life, biometric or genetic data, except in the cases defined by legislation.
3. RIGHTS OF PERSONAL DATA SUBJECTS.
3.1. When visiting/using the Website you have the right to: • receive from the Foundation information not specified in this Policy regarding the processing of and the conditions for granting access to your personal data, or to issue an appropriate instruction for persons authorised by you to obtain this information, except in the cases defined by legislation;
• free access to your personal data;
• receive a response to a request concerning the processing of your personal data in the manner and within the time limit defined by the current legislation;
• submit a reasoned demand objecting to the processing of your personal data, or concerning the alteration or destruction of your personal data, if such data is processed unlawfully or is inaccurate;
• the protection of your personal data against unlawful processing and accidental loss, destruction or damage in connection with deliberate concealment, failure to provide or untimely provision of such data, as well as protection against the provision of information that is inaccurate or that damages the honour, dignity and business reputation of a natural person;
• withdraw your consent to the processing of personal data; and also to exercise other rights defined by the current legislation on personal data protection.
3.2. You have the right to raise questions related to the collection, use, storage and other processing of your personal data with the Ukrainian Parliament Commissioner for Human Rights, who can be contacted at the email address
